Game conditions

  1. General

These are the game conditions of Zuiver B.V. (hereinafter referred to as: “Organiser”), which is located at Schoot 2 in 1551 NB Westzaan, and apply to promotional games of chance organised by the Organiser, possibly in collaboration with third parties. Promotional games of chance are subject to the Code of Conduct for Promotional Games of Chance 2014, which came into effect on 1 January 2014. The Organiser agrees to always act in accordance with the Code of Conduct. Participation in a promotion is equivalent to accepting the game conditions. Disputes relating to these game conditions will not be considered under any circumstances. Questions or comments concerning the game conditions or promotions should be directed to the Organiser.

  1. Participation and participants

Participation is possible for all persons, except the employees of the Organiser and/or its affiliated companies and/or suppliers or sponsor with whom the Organiser collaborates for the concerned promotions and awarded prizes. Participants are obligated to personally carry out all application formalities, which includes completing the participation form. Any costs associated with participation will be mentioned when the promotion is announced. Participants under the age of 18 years hereby confirm to have received consent to participate in the concerned promotion from their legal guardian. If it transpires that such consent has not been provided, the Organiser can decide to not award the prize, unless the participant can still demonstrate that consent had been provided. The Organiser will at all times be entitled to ask participants to present a copy of a valid identity document. Natural persons that take part in promotions via a third party/intermediary will not qualify for participation. The Organiser retains the right to exclude such persons/parties from participation. The Organiser is entitled to exclude promotion participants if it transpires that they supplied inaccurate, incomplete or misleading details or in any way committed or attempted to commit fraud. In under no circumstances can the Organiser be held responsible for the participant supplying an incorrect telephone number, e-mail address or home address, which leads to an incorrect or unknown address for the participant, or for malfunctions in networks, hardware or software which restrict or delay the supply of details by the participant, or lead to the loss of such details.

  1. Prizes

Winners of potential prizes or premiums will be selected in an unbiased manner. Prizes cannot be exchanged for cash or other prizes. If various identical prizes are available, the Organiser will award just one item/prize per telephone number, e-mail address or residential address. Prize winners will be notified in person within three months of the end of the promotion, at the latest. The results will also be publicly posted on the indicated website or another official medium. Correspondence about the results of promotions is not permitted. The Organiser will award non-cash prizes in the condition in which they find themselves at that moment in time. The Organiser is not liable for any (visible and/or concealed) shortcomings in prizes and/or any other damage to prizes (this includes damage caused during consignment and/or another means of transport). The Organiser will be responsible for settling gaming tax and VAT payable on awarded prizes. By participating in promotions, prize winners confirm that they are willing to cooperate with promotional activities relating to the promotion, which includes the prize draw. Photos can be used by the Organiser for publicity purposes. By participating in the promotion, participants also automatically agree to receive a digital newsletter for all Zuiver b.v. brands.

  1. Details

By taking part in the promotion, participants automatically give the Organiser permission to collect details and share them with third parties. Participants confirm that they are familiar with the collection and supply of the above mentioned details, and the purposes for which they can be used, and agree with the Organiser’s privacy and cookie policy.

  1. Changes in Game conditions and technical provisions

The Organiser is entitled to change these general game conditions at any given moment; we advise you to read these conditions on a regular basis. The Organiser does not guarantee undisturbed and continuous operation of its website(s) or the services it supplies or uses. Even though the Organiser will do everything to effectively manage its website, it could still contain incomplete or inaccurate information. Participants are personally responsible for ensuring facilities (like telecommunication equipment) needed to take part in promotions.

  1. Complaints

If participants have complaints or objections concerning promotions organised by the Organiser, then participants are entitled to report them to the Organiser within 5 working days of the complaint being encountered, or with a reasonable period within which they should have been encountered, by sending a letter to Zuiver B.V. featuring the reference ‘complaint promotional game of chance’. The Organiser will then address the complaint and contact the participant about how it will be further processed. If the complaint about promotional games of chance has not been processed to the satisfaction of the complainant, it is possible to submit a complaint to the Games of Chance Authority.

  1. Liability

The Organiser is not liable for any damage that is the result of, or is associated with, (participating in) the promotions it organises. Printing, game-related, layout-related or other such errors cannot be held against the Organiser and can, under no circumstances, lead to obligations on the part of the Organiser. The Organiser is not liable for any damage, irrespective of its nature, relating to the use of its website or links to third party websites found on the Organiser’s website or that of other technical facilities. The Organiser is not responsible or liable for costs incurred by participants when participating in promotions.

  1. Force majeure

In case of force majeure, the Organiser retains the right to suspend, terminate or modify the promotion at any given moment and to not award one or more of the prizes. Force majeure will certainly include bankruptcy of the supplier and/or sponsor of a prize or application for suspension of payments by the concerned supplier and/or sponsor. In such cases, the Organiser can decide to provide an alternative prize.

  1. Applicable law

These game conditions and organised promotions are subject to Dutch law. All disputes in this regard will be presented to the qualified court in Amsterdam.
